Privacy Policy
We are very pleased about your interest in our company. Data protection is a particularly high priority for the management of Dutyfarm GmbH. It is generally possible to use the websites of Dutyfarm GmbH without providing any personal data. However, if a data subject wishes to use particular services provided by our company through our website, the processing of personal data may become necessary. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the data subject's consent.
The processing of personal data, such as a data subject's name, address, email address or telephone number, is always carried out in accordance with the General Data Protection Regulation and the country-specific data protection provisions applicable to Dutyfarm GmbH. Through this privacy policy, our company wishes to inform the public about the nature, scope and purpose of the personal data we collect, use and process. This privacy policy also informs data subjects of their rights.
As the controller, Dutyfarm GmbH has implemented numerous technical and organisational measures to ensure the most comprehensive protection possible for personal data processed through this website. Nevertheless, internet-based data transmissions may inherently have security vulnerabilities, meaning that absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us by alternative means, for example by telephone.
1. Definitions
The privacy policy of Dutyfarm GmbH is based on the terminology used by the European legislator when adopting the General Data Protection Regulation (GDPR). Our privacy policy is intended to be easy to read and understand for the public as well as for our customers and business partners. To ensure this, we would first like to explain the terminology used.
In this privacy policy, we use, among others, the following terms:
a) personal data
Personal data means any information relating to an identified or identifiable natural person (hereinafter referred to as a "data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
b) data subject
A data subject is any identified or identifiable natural person whose personal data are processed by the controller.
c) processing
Processing means any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
d) restriction of processing
Restriction of processing means the marking of stored personal data with the aim of limiting their processing in the future.
e) profiling
Profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.
f) pseudonymisation
Pseudonymisation means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.
g) controller or controller responsible for processing
A controller or controller responsible for processing is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.
h) processor
A processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
i) recipient
A recipient is a natural or legal person, public authority, agency or other body to which personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law are not regarded as recipients.
j) third party
A third party is a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.
k) consent
Consent means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which they, by a statement or by a clear affirmative action, signify agreement to the processing of personal data relating to them.
2. Name and address of the controller
The controller for the purposes of the General Data Protection Regulation, other data protection laws applicable in the Member States of the European Union and other provisions relating to data protection is:
Dutyfarm GmbH
Hauptstraße 6D
10317 Berlin
Deutschland
Email: info@dutyfarm.com
Website: www.dutyfarm.com
3. Cookies
The websites of Dutyfarm GmbH use cookies. Cookies are text files that are placed and stored on a computer system through an internet browser.
Numerous websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier for the cookie. It consists of a string of characters that enables websites and servers to associate the cookie with the specific internet browser in which it was stored. This allows the websites and servers visited to distinguish the data subject's individual browser from other internet browsers containing different cookies. A particular internet browser can be recognised and identified by its unique cookie ID.
By using cookies, Dutyfarm GmbH can provide users of this website with more user-friendly services that would not be possible without setting cookies.
Cookies can be used to optimise the information and offers on our website for the benefit of the user. As already mentioned, cookies enable us to recognise users of our website. The purpose of this recognition is to make our website easier to use. For example, users of a website that uses cookies do not have to enter their login details again each time they visit the website, because this is handled by the website and the cookie stored on the user's computer system. Another example is a cookie for a shopping basket in an online shop. The online shop uses a cookie to remember the items a customer has placed in the virtual shopping basket.
The data subject can prevent our website from setting cookies at any time by adjusting the settings of the internet browser used, thereby permanently objecting to the setting of cookies. Cookies that have already been set can also be deleted at any time through an internet browser or other software programs. This is possible in all commonly used internet browsers. If the data subject disables cookies in the internet browser used, it may not be possible to use all the functions of our website in full.
4. Collection of general data and information
The website of Dutyfarm GmbH collects a range of general data and information each time a data subject or an automated system accesses the website. These general data and information are stored in the server's log files. The data collected may include (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrers), (4) the subpages accessed on our website by an accessing system, (5) the date and time of access to the website, (6) an internet protocol address (IP address), (7) the internet service provider of the accessing system and (8) other similar data and information used to prevent risks in the event of attacks on our information technology systems.
When using these general data and information, Dutyfarm GmbH does not draw any conclusions about the data subject. Rather, this information is required to (1) deliver the content of our website correctly, (2) optimise the content of our website and the advertising for it, (3) ensure the continued functioning of our information technology systems and the technology of our website and (4) provide law enforcement authorities with the information necessary for prosecution in the event of a cyberattack. Dutyfarm GmbH therefore analyses these anonymously collected data and information both statistically and with the aim of improving data protection and data security within our company, ultimately to ensure an optimal level of protection for the personal data we process. The anonymous data in the server log files are stored separately from all personal data provided by a data subject.
5. Registration on our website
The data subject may register on the controller's website by providing personal data. The personal data transmitted to the controller are determined by the input form used for registration. The personal data entered by the data subject are collected and stored exclusively for internal use by the controller and for the controller's own purposes. The controller may arrange for the data to be passed on to one or more processors, for example a parcel delivery service provider, which also uses the personal data exclusively for an internal purpose attributable to the controller.
Registration on the controller's website also results in the storage of the IP address assigned by the data subject's internet service provider (ISP), as well as the date and time of registration. These data are stored because this is the only way to prevent misuse of our services and, where necessary, these data make it possible to investigate offences that have been committed. In this respect, storing these data is necessary to protect the controller. As a rule, these data are not disclosed to third parties unless there is a legal obligation to disclose them or the disclosure serves law enforcement purposes.
The data subject's registration, involving the voluntary provision of personal data, enables the controller to offer the data subject content or services which, by their nature, can only be offered to registered users. Registered persons are free to change the personal data provided during registration at any time or to have them completely erased from the controller's records.
Upon request, the controller will inform any data subject at any time of the personal data stored about them. The controller will also rectify or erase personal data at the data subject's request or notification, provided that no statutory retention obligations prevent this. All of the controller's employees are available to the data subject as contacts in this regard.
6. Subscription to our newsletter
Users of the website of Dutyfarm GmbH are given the opportunity to subscribe to our company's newsletter. The personal data transmitted to the controller when subscribing to the newsletter are determined by the input form used for this purpose.
Dutyfarm GmbH regularly informs its customers and business partners about the company's offers by means of a newsletter. As a rule, the data subject can only receive our company's newsletter if (1) the data subject has a valid email address and (2) the data subject registers to receive the newsletter. For legal reasons, a confirmation email using the double opt-in procedure is sent to the email address first entered by a data subject to receive the newsletter. This confirmation email is used to verify whether the owner of the email address, as the data subject, has authorised receipt of the newsletter.
When a data subject subscribes to the newsletter, we also store the IP address assigned by the internet service provider (ISP) to the computer system used by the data subject at the time of registration, as well as the date and time of registration. Collecting these data is necessary to make it possible to trace any potential misuse of a data subject's email address at a later date and therefore serves to safeguard the controller legally.
The personal data collected when subscribing to the newsletter are used exclusively to send our newsletter. Newsletter subscribers may also be informed by email where this is necessary for the operation of the newsletter service or a related registration, as may be the case if the newsletter offering or technical circumstances change. The personal data collected as part of the newsletter service will not be disclosed to third parties. The data subject may cancel their subscription to our newsletter at any time. Consent to the storage of personal data, which the data subject has given us for the purpose of sending the newsletter, may be withdrawn at any time. Each newsletter contains a corresponding link for withdrawing consent. It is also possible to unsubscribe from the newsletter at any time directly on the controller's website or to notify the controller by other means.
7. Newsletter tracking
The newsletters of Dutyfarm GmbH contain so-called tracking pixels. A tracking pixel is a miniature graphic embedded in emails sent in HTML format to enable log file recording and analysis. This makes it possible to statistically evaluate the success or failure of online marketing campaigns. Using the embedded tracking pixel, Dutyfarm GmbH can determine whether and when a data subject opened an email and which links in the email the data subject accessed.
Personal data collected through the tracking pixels contained in the newsletters are stored and analysed by the controller to optimise newsletter distribution and to tailor the content of future newsletters even more closely to the data subject's interests. These personal data are not disclosed to third parties. Data subjects are entitled at any time to withdraw the separate consent given for this purpose through the double opt-in procedure. Following withdrawal, these personal data will be erased by the controller. Dutyfarm GmbH automatically treats unsubscribing from the newsletter as a withdrawal of consent.
8. Contact options through the website
In accordance with statutory requirements, the website of Dutyfarm GmbH contains information that enables rapid electronic contact with our company and direct communication with us, including a general electronic mail address (email address). If a data subject contacts the controller by email or through a contact form, the personal data transmitted by the data subject are automatically stored. Personal data transmitted voluntarily by a data subject to the controller in this way are stored for the purpose of handling the enquiry or contacting the data subject. These personal data are not disclosed to third parties.
9. Comment function in the blog on the website
Dutyfarm GmbH offers users the opportunity to leave individual comments on individual blog posts in a blog located on the controller's website. A blog is a portal maintained on a website, generally accessible to the public, in which one or more persons, known as bloggers or web bloggers, can post articles or write down thoughts in so-called blog posts. Third parties can generally comment on these blog posts.
If a data subject leaves a comment in the blog published on this website, the comments left by the data subject are stored and published together with information about the time the comment was submitted and the username (pseudonym) chosen by the data subject. The IP address assigned by the data subject's internet service provider (ISP) is also logged. This IP address is stored for security reasons and in case the data subject infringes the rights of third parties or posts unlawful content through a comment. These personal data are therefore stored in the controller's own interest so that the controller may, where necessary, be able to exonerate itself in the event of an infringement. These collected personal data will not be disclosed to third parties unless such disclosure is required by law or serves the controller's legal defence.
10. Subscription to comments in the blog on the website
Third parties can generally subscribe to comments posted in the blog of Dutyfarm GmbH. In particular, a commenter may subscribe to comments that follow their own comment on a particular blog post.
If a data subject chooses to subscribe to comments, the controller sends an automatic confirmation email to verify, through the double opt-in procedure, whether the owner of the specified email address actually selected this option. The subscription to comments may be cancelled at any time.
11. Routine erasure and blocking of personal data
The controller processes and stores the data subject's personal data only for the period necessary to achieve the purpose of storage or to the extent provided for by the European legislator or another legislator in laws or regulations to which the controller is subject.
If the purpose of storage no longer applies or a storage period prescribed by the European legislator or another competent legislator expires, the personal data are routinely blocked or erased in accordance with statutory provisions.
12. Rights of the data subject
a) Right to confirmation
Every data subject has the right granted by the European legislator to obtain confirmation from the controller as to whether personal data concerning them are being processed. If a data subject wishes to exercise this right to confirmation, they may contact an employee of the controller at any time.
b) Right of access
Every data subject whose personal data are processed has the right granted by the European legislator to obtain, at any time and free of charge, information from the controller about the personal data stored concerning them and a copy of that information. The European legislator has also granted the data subject access to the following information:
the purposes of the processing
the categories of personal data being processed
the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations
where possible, the envisaged period for which the personal data will be stored or, if this is not possible, the criteria used to determine that period
the existence of the right to request rectification or erasure of personal data concerning them or restriction of processing by the controller, or to object to such processing
the existence of the right to lodge a complaint with a supervisory authority
where the personal data are not collected from the data subject: any available information as to their source
the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the data subject
The data subject also has the right to be informed whether personal data have been transferred to a third country or an international organisation. Where this is the case, the data subject also has the right to be informed of the appropriate safeguards relating to the transfer.
If a data subject wishes to exercise this right of access, they may contact an employee of the controller at any time.
c) Right to rectification
Every data subject whose personal data are processed has the right granted by the European legislator to obtain the rectification of inaccurate personal data concerning them without undue delay. Taking into account the purposes of the processing, the data subject also has the right to have incomplete personal data completed, including by providing a supplementary statement.
If a data subject wishes to exercise this right to rectification, they may contact an employee of the controller at any time.
d) Right to erasure (right to be forgotten)
Every data subject whose personal data are processed has the right granted by the European legislator to request that the controller erase personal data concerning them without undue delay where one of the following grounds applies and insofar as the processing is not necessary:
The personal data were collected or otherwise processed for purposes for which they are no longer necessary.
The data subject withdraws consent on which the processing was based under Article 6(1)(a) GDPR or Article 9(2)(a) GDPR, and there is no other legal basis for the processing.
The data subject objects to the processing under Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing under Article 21(2) GDPR.
The personal data have been unlawfully processed.
The personal data must be erased to comply with a legal obligation under Union or Member State law to which the controller is subject.
The personal data were collected in relation to the offer of information society services referred to in Article 8(1) GDPR.
If one of the above grounds applies and a data subject wishes to arrange for the erasure of personal data stored by Dutyfarm GmbH, they may contact an employee of the controller at any time. The employee of Dutyfarm GmbH will arrange for the erasure request to be complied with without undue delay.
Where Dutyfarm GmbH has made personal data public and our company, as the controller, is obliged to erase the personal data under Article 17(1) GDPR, Dutyfarm GmbH, taking account of available technology and the cost of implementation, will take reasonable steps, including technical measures, to inform other controllers processing the published personal data that the data subject has requested the erasure by those other controllers of any links to, or copies or replications of, those personal data, insofar as the processing is not necessary. The employee of Dutyfarm GmbH will arrange the necessary measures in each individual case.
e) Right to restriction of processing
Every data subject whose personal data are processed has the right granted by the European legislator to obtain restriction of processing from the controller where one of the following conditions applies:
The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
The processing is unlawful and the data subject opposes the erasure of the personal data and requests restriction of their use instead.
The controller no longer needs the personal data for the purposes of processing, but the data subject requires them for the establishment, exercise or defence of legal claims.
The data subject has objected to processing under Article 21(1) GDPR and verification of whether the controller's legitimate grounds override those of the data subject is still pending.
If one of the above conditions applies and a data subject wishes to request restriction of processing of personal data stored by Dutyfarm GmbH, they may contact an employee of the controller at any time. The employee of Dutyfarm GmbH will arrange for the restriction of processing.
f) Right to data portability
Every data subject whose personal data are processed has the right granted by the European legislator to receive the personal data concerning them which they have provided to a controller in a structured, commonly used and machine-readable format. They also have the right to transmit those data to another controller without hindrance from the controller to which the personal data were provided, where the processing is based on consent under Article 6(1)(a) GDPR or Article 9(2)(a) GDPR or on a contract under Article 6(1)(b) GDPR and is carried out by automated means, provided that the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Furthermore, when exercising their right to data portability under Article 20(1) GDPR, the data subject has the right to have personal data transmitted directly from one controller to another, where technically feasible and provided that this does not adversely affect the rights and freedoms of others.
To exercise the right to data portability, the data subject may contact an employee of Dutyfarm GmbH at any time.
g) Right to object
Every data subject whose personal data are processed has the right granted by the European legislator to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them based on Article 6(1)(e) or (f) GDPR. This also applies to profiling based on those provisions.
In the event of an objection, Dutyfarm GmbH will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the establishment, exercise or defence of legal claims.
Where Dutyfarm GmbH processes personal data for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data for such marketing. This also applies to profiling insofar as it is related to such direct marketing. If the data subject objects to Dutyfarm GmbH's processing for direct marketing purposes, Dutyfarm GmbH will no longer process the personal data for those purposes.
The data subject also has the right, on grounds relating to their particular situation, to object to the processing of personal data concerning them by Dutyfarm GmbH for scientific or historical research purposes or statistical purposes under Article 89(1) GDPR, unless such processing is necessary for the performance of a task carried out in the public interest.
To exercise the right to object, the data subject may contact any employee of Dutyfarm GmbH or another employee directly. In the context of the use of information society services, and notwithstanding Directive 2002/58/EC, the data subject is also free to exercise their right to object by automated means using technical specifications.
h) Automated individual decision-making, including profiling
Every data subject whose personal data are processed has the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them, provided that the decision (1) is not necessary for entering into, or performing, a contract between the data subject and the controller, or (2) is authorised by Union or Member State law to which the controller is subject and that law provides suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, or (3) is based on the data subject's explicit consent.
If the decision (1) is necessary for entering into, or performing, a contract between the data subject and the controller or (2) is based on the data subject's explicit consent, Dutyfarm GmbH will implement suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, including at least the right to obtain human intervention on the part of the controller, to express their point of view and to contest the decision.
If the data subject wishes to exercise rights relating to automated decisions, they may contact an employee of the controller at any time.
i) Right to withdraw consent under data protection law
Every data subject whose personal data are processed has the right granted by the European legislator to withdraw consent to the processing of personal data at any time.
If the data subject wishes to exercise their right to withdraw consent, they may contact an employee of the controller at any time.
13. Data protection for applications and the recruitment process
The controller collects and processes applicants' personal data for the purpose of handling the recruitment process. Processing may also take place electronically. This is particularly the case where an applicant submits the relevant application documents to the controller electronically, for example by email or through a web form on the website. If the controller enters into an employment contract with an applicant, the data transmitted will be stored for the purpose of administering the employment relationship in compliance with statutory provisions. If the controller does not enter into an employment contract with the applicant, the application documents will be automatically erased two months after notification of the rejection decision, provided that no other legitimate interests of the controller prevent erasure. Another legitimate interest in this sense may, for example, be an obligation to provide evidence in proceedings under the General Equal Treatment Act (AGG).
14. Data protection provisions on the use of Facebook
The controller has integrated components of the company Facebook into this website. Facebook is a social network.
A social network is a social meeting place on the internet, an online community that generally allows users to communicate with each other and interact in a virtual space. A social network can serve as a platform for sharing opinions and experiences or enable the internet community to provide personal or company-related information. Among other things, Facebook allows users of its social network to create personal profiles, upload photos and connect through friend requests.
The operating company of Facebook is Facebook, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. Where a data subject lives outside the USA or Canada, the controller responsible for processing personal data is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.
Each time an individual page of this website, which is operated by the controller and contains an integrated Facebook component (Facebook plug-in), is accessed, the relevant Facebook component automatically causes the internet browser on the data subject's information technology system to download a display of the corresponding Facebook component from Facebook. A complete overview of all Facebook plug-ins is available at https://developers.facebook.com/docs/plugins/?locale=de_DE. As part of this technical process, Facebook learns which specific subpage of our website the data subject visits.
If the data subject is logged in to Facebook at the same time, Facebook recognises which specific subpage of our website the data subject visits each time they access our website and throughout their visit. This information is collected by the Facebook component and assigned by Facebook to the data subject's Facebook account. If the data subject clicks one of the Facebook buttons integrated into our website, for example the "Like" button, or leaves a comment, Facebook assigns this information to the data subject's personal Facebook user account and stores these personal data.
Facebook always receives information through the Facebook component that the data subject has visited our website if the data subject is logged in to Facebook at the time of accessing our website; this happens regardless of whether the data subject clicks the Facebook component. If the data subject does not want this information to be transmitted to Facebook, they can prevent the transmission by logging out of their Facebook account before accessing our website.
The data policy published by Facebook, available at https://de-de.facebook.com/about/privacy/, provides information about Facebook's collection, processing and use of personal data. It also explains the settings Facebook offers to protect the data subject's privacy. Various applications are also available that make it possible to prevent data from being transmitted to Facebook. The data subject can use such applications to prevent data transmission to Facebook.
15. Data protection provisions on the use of features of the Amazon Associates Programme
As a participant in the Amazon Associates Programme, the controller has integrated Amazon components into this website. Amazon designed these components with the aim of referring customers through advertisements to various websites of the Amazon group, in particular Amazon.co.uk, Local.Amazon.co.uk, Amazon.de, BuyVIP.com, Amazon.fr, Amazon.it and Amazon.es. BuyVIP.com, in return for commission payments. The controller can generate advertising revenue by using the Amazon components.
The operating company of these Amazon components is Amazon EU S.à.r.l, 5 Rue Plaetis, L-2338 Luxembourg, Luxemburg.
Amazon places a cookie on the data subject's information technology system. Cookies have already been explained above. Each time an individual page of this website, which is operated by the controller and contains an integrated Amazon component, is accessed, the relevant Amazon component automatically causes the internet browser on the data subject's information technology system to transmit data to Amazon for the purposes of online advertising and calculating commissions. As part of this technical process, Amazon obtains personal data that it uses to trace the origin of orders received by Amazon and subsequently enable commission calculations. Among other things, Amazon can track whether the data subject has clicked an affiliate link on our website.
As already explained above, the data subject can prevent our website from setting cookies at any time by adjusting the settings of the internet browser used, thereby permanently objecting to the setting of cookies. Such a browser setting would also prevent Amazon from placing a cookie on the data subject's information technology system. Cookies already set by Amazon can also be deleted at any time through an internet browser or other software programs.
Further information and Amazon's applicable data protection provisions are available at https://www.amazon.de/gp/help/customer/display.html?nodeId=3312401.
16. Data protection provisions on the use of features of Verwertungsgesellschaft WORT (VG WORT)
The controller has integrated tracking pixels into this website. A tracking pixel is a miniature graphic embedded in websites to enable log file recording and analysis, allowing statistical evaluation to be carried out. The integrated tracking pixels are used for the Scalable Central Measurement Method (SZM) of Verwertungsgesellschaft WORT (VG-Wort).
The Scalable Central Measurement Method is operated by INFOnline GmbH, Forum Bonn Nord, Brühler Str. 9, 53119 Bonn.
The Scalable Central Measurement Method is used to determine statistical indicators for calculating the probability of texts being copied. The embedded tracking pixel enables Verwertungsgesellschaft WORT to determine whether, when and by how many users (including the data subject) our website was opened and which content was accessed.
The data obtained through the Scalable Central Measurement Method are collected anonymously. To record access figures and recognise website users, either a so-called session cookie is set, creating a signature consisting of various automatically transmitted items of information, or alternative methods are used. The IP address of the internet connection used by the data subject is collected and processed only in anonymised form. The data subject is not identified at any time.
As already explained above, the data subject can prevent our website from setting cookies at any time by adjusting the settings of the internet browser used, thereby permanently objecting to the setting of cookies. Such a browser setting would also prevent INFOnline from placing a cookie on the data subject's information technology system. Cookies already set by INFOnline can also be deleted at any time through an internet browser or other software programs.
The data subject may also object to and prevent the collection of data generated by INFOnline relating to the use of this website and the processing of these data by INFOnline. To do so, the data subject must click the opt-out button at http://optout.ioam.de, which sets an opt-out cookie. The opt-out cookie set when objecting is stored on the information technology system used by the data subject. If the cookies on the data subject's system are deleted after an objection, the data subject must access the link again and set a new opt-out cookie.
However, setting the opt-out cookie may mean that the data subject can no longer use the controller's websites in full.
INFOnline's applicable data protection provisions are available at https://www.infonline.de/datenschutz/.
17. Data protection provisions on the use of Google AdSense
The controller has integrated Google AdSense into this website. Google AdSense is an online service that enables advertisements to be placed on third-party websites. Google AdSense is based on an algorithm that selects advertisements displayed on third-party websites to match the content of the respective website. Google AdSense enables interest-based targeting of internet users, implemented by generating individual user profiles.
The operating company of the Google AdSense component is Alphabet Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
The purpose of the Google AdSense component is to incorporate advertisements into our website. Google AdSense places a cookie on the data subject's information technology system. Cookies have already been explained above. Setting the cookie enables Alphabet Inc. to analyse the use of our website. Each time an individual page of this website, which is operated by the controller and contains an integrated Google AdSense component, is accessed, the relevant Google AdSense component automatically causes the internet browser on the data subject's information technology system to transmit data to Alphabet Inc. for the purposes of online advertising and calculating commissions. As part of this technical process, Alphabet Inc. obtains personal data, such as the data subject's IP address, which it uses, among other things, to trace the origin of visitors and clicks and subsequently enable commission calculations.
As already explained above, the data subject can prevent our website from setting cookies at any time by adjusting the settings of the internet browser used, thereby permanently objecting to the setting of cookies. Such a browser setting would also prevent Alphabet Inc. from placing a cookie on the data subject's information technology system. A cookie already set by Alphabet Inc. can also be deleted at any time through the internet browser or other software programs.
Google AdSense also uses so-called tracking pixels. A tracking pixel is a miniature graphic embedded in websites to enable log file recording and analysis, allowing statistical evaluation to be carried out. Using the embedded tracking pixel, Alphabet Inc. can determine whether and when a data subject opened a website and which links the data subject clicked. Tracking pixels are used, among other things, to analyse visitor traffic on a website.
Through Google AdSense, personal data and information, including the IP address and information necessary for recording and billing the advertisements displayed, are transmitted to Alphabet Inc. in the United States of America. These personal data are stored and processed in the United States of America. Alphabet Inc. may disclose these personal data collected through the technical process to third parties.
Google AdSense is explained in greater detail at https://www.google.de/intl/de/adsense/start/.
18. Data protection provisions on the use of Google Analytics (with anonymisation function)
The controller has integrated the Google Analytics component (with anonymisation function) into this website. Google Analytics is a web analytics service. Web analytics involves collecting, compiling and evaluating data about the behaviour of website visitors. A web analytics service records, among other things, data about the website from which a data subject arrived at a website (so-called referrers), which subpages of the website were accessed, or how often and for how long a subpage was viewed. Web analytics is mainly used to optimise a website and to analyse the costs and benefits of internet advertising.
The operating company of the Google Analytics component is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
For web analytics through Google Analytics, the controller uses the extension "_gat._anonymizeIp". This extension causes Google to truncate and anonymise the IP address of the data subject's internet connection when our websites are accessed from a Member State of the European Union or another state party to the Agreement on the European Economic Area.
The purpose of the Google Analytics component is to analyse visitor traffic on our website. Google uses the data and information obtained, among other things, to evaluate the use of our website, compile online reports for us showing activity on our websites, and provide further services relating to the use of our website.
Google Analytics places a cookie on the data subject's information technology system. Cookies have already been explained above. Setting the cookie enables Google to analyse the use of our website. Each time an individual page of this website, which is operated by the controller and contains an integrated Google Analytics component, is accessed, the relevant Google Analytics component automatically causes the internet browser on the data subject's information technology system to transmit data to Google for online analysis. As part of this technical process, Google obtains personal data, such as the data subject's IP address, which it uses, among other things, to trace the origin of visitors and clicks and subsequently enable commission calculations.
The cookie stores personal information, for example the time of access, the location from which access originated and the frequency of the data subject's visits to our website. Each time our websites are visited, these personal data, including the IP address of the internet connection used by the data subject, are transmitted to Google in the United States of America. Google stores these personal data in the United States of America. Google may disclose these personal data collected through the technical process to third parties.
As already explained above, the data subject can prevent our website from setting cookies at any time by adjusting the settings of the internet browser used, thereby permanently objecting to the setting of cookies. Such a browser setting would also prevent Google from placing a cookie on the data subject's information technology system. A cookie already set by Google Analytics can also be deleted at any time through the internet browser or other software programs.
The data subject may also object to and prevent the collection of data generated by Google Analytics relating to the use of this website and the processing of these data by Google. To do so, the data subject must download and install a browser add-on at https://tools.google.com/dlpage/gaoptout. This browser add-on informs Google Analytics through JavaScript that no data or information about visits to websites may be transmitted to Google Analytics. Google treats installation of the browser add-on as an objection. If the data subject's information technology system is erased, formatted or reinstalled at a later date, the data subject must reinstall the browser add-on to disable Google Analytics. If the browser add-on is uninstalled or disabled by the data subject or another person within their sphere of control, the browser add-on can be reinstalled or reactivated.
Further information and Google's applicable data protection provisions are available at https://www.google.de/intl/de/policies/privacy/ and http://www.google.com/analytics/terms/de.html. Google Analytics is explained in greater detail at https://www.google.com/intl/de_de/analytics/.
19. Data protection provisions on the use of Google Remarketing
The controller has integrated Google Remarketing services into this website. Google Remarketing is a feature of Google AdWords that enables a company to display advertisements to internet users who have previously visited the company's website. Integrating Google Remarketing therefore allows a company to create user-specific advertising and consequently display advertisements relevant to the internet user's interests.
The operating company of Google Remarketing services is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
The purpose of Google Remarketing is to display interest-based advertising. Google Remarketing allows us to display advertisements through the Google advertising network or on other websites that are tailored to internet users' individual needs and interests.
Google Remarketing places a cookie on the data subject's information technology system. Cookies have already been explained above. Setting the cookie enables Google to recognise a visitor to our website when they subsequently access websites that are also members of the Google advertising network. Each time a website containing an integrated Google Remarketing service is accessed, the data subject's internet browser automatically identifies itself to Google. As part of this technical process, Google obtains personal data, such as the user's IP address or browsing behaviour, which it uses, among other things, to display interest-based advertising.
The cookie stores personal information, for example the websites visited by the data subject. Each time our websites are visited, personal data, including the IP address of the internet connection used by the data subject, are therefore transmitted to Google in the United States of America.
The data subject may also object to interest-based advertising by Google. To do so, the data subject must access www.google.de/settings/ads from each internet browser they use and select the desired settings there.
Further information and Google's applicable data protection provisions are available at https://www.google.de/intl/de/policies/privacy/.
20. Data protection provisions on the use of Google+
The controller has integrated the Google+ button as a component into this website. Google+ is a so-called social network. A social network is a social meeting place on the internet, an online community that generally allows users to communicate with each other and interact in a virtual space. A social network can serve as a platform for sharing opinions and experiences or enable the internet community to provide personal or company-related information. Among other things, Google+ allows users of its social network to create personal profiles, upload photos and connect through friend requests.
The operating company of Google+ is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
Each time an individual page of this website, which is operated by the controller and contains an integrated Google+ button, is accessed, the relevant Google+ button automatically causes the internet browser on the data subject's information technology system to download a display of the corresponding Google+ button from Google. As part of this technical process, Google learns which specific subpage of our website the data subject visits. More detailed information about Google+ is available at https://developers.google.com/+/.
If the data subject is logged in to Google+ at the same time, Google recognises which specific subpage of our website the data subject visits each time they access our website and throughout their visit. This information is collected by the Google+ button and assigned by Google to the data subject's Google+ account.
If the data subject clicks one of the Google+ buttons integrated into our website and thereby makes a Google+1 recommendation, Google assigns this information to the data subject's personal Google+ user account and stores these personal data. Google stores the data subject's Google+1 recommendation and makes it publicly accessible in accordance with the terms accepted by the data subject in this respect. A Google+1 recommendation made by the data subject on this website is subsequently stored and processed together with other personal data, such as the name of the Google+1 account used by the data subject and the photo stored in it, in other Google services, for example the search results of Google's search engine, the data subject's Google account or elsewhere, for example on websites or in connection with advertisements. Google is also able to link the visit to this website with other personal data stored by Google. Google also records this personal information for the purpose of improving or optimising its various services.
Google always receives information through the Google+ button that the data subject has visited our website if the data subject is logged in to Google+ at the time of accessing our website; this happens regardless of whether the data subject clicks the Google+ button.
If the data subject does not want personal data to be transmitted to Google, they can prevent such transmission by logging out of their Google+ account before accessing our website.
Further information and Google's applicable data protection provisions are available at https://www.google.de/intl/de/policies/privacy/. Further guidance from Google on the Google+1 button is available at https://developers.google.com/+/web/buttons-policy.
21. Data protection provisions on the use of Google AdWords
The controller has integrated Google AdWords into this website. Google AdWords is an internet advertising service that allows advertisers to place advertisements both in Google's search engine results and in the Google advertising network. Google AdWords allows an advertiser to specify certain keywords in advance, so that an advertisement is displayed in Google's search engine results only when the user retrieves a search result relevant to those keywords. In the Google advertising network, advertisements are distributed to websites with relevant subject matter using an automatic algorithm and taking the previously specified keywords into account.
The operating company of Google AdWords services is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
The purpose of Google AdWords is to promote our website by displaying interest-based advertising on the websites of third-party companies and in the search results of Google's search engine, and to display third-party advertising on our website.
If a data subject reaches our website through a Google advertisement, Google places a so-called conversion cookie on the data subject's information technology system. Cookies have already been explained above. A conversion cookie expires after thirty days and is not used to identify the data subject. Provided that it has not yet expired, the conversion cookie is used to track whether certain subpages, for example the shopping basket of an online shop system, have been accessed on our website. The conversion cookie enables both us and Google to track whether a data subject who reached our website through an AdWords advertisement generated revenue, that is, completed or abandoned a purchase.
Google uses the data and information collected through the conversion cookie to compile visit statistics for our website. We in turn use these visit statistics to determine the total number of users referred to us through AdWords advertisements, in order to determine the success or failure of each AdWords advertisement and optimise our AdWords advertisements for the future. Neither our company nor other Google AdWords advertisers receive information from Google that could be used to identify the data subject.
The conversion cookie stores personal information, for example the websites visited by the data subject. Each time our websites are visited, personal data, including the IP address of the internet connection used by the data subject, are therefore transmitted to Google in the United States of America. Google stores these personal data in the United States of America. Google may disclose these personal data collected through the technical process to third parties.
As already explained above, the data subject can prevent our website from setting cookies at any time by adjusting the settings of the internet browser used, thereby permanently objecting to the setting of cookies. Such a browser setting would also prevent Google from placing a conversion cookie on the data subject's information technology system. A cookie already set by Google AdWords can also be deleted at any time through the internet browser or other software programs.
The data subject may also object to interest-based advertising by Google. To do so, the data subject must access www.google.de/settings/ads from each internet browser they use and select the desired settings there.
Further information and Google's applicable data protection provisions are available at https://www.google.de/intl/de/policies/privacy/.
22. Data protection provisions on the use of Instagram
The controller has integrated components of the Instagram service into this website. Instagram is a service that can be classified as an audiovisual platform and allows users to share photos and videos and to distribute such data on other social networks.
The operating company of Instagram services is Instagram LLC, 1 Hacker Way, Building 14 First Floor, Menlo Park, CA, USA.
Each time an individual page of this website, which is operated by the controller and contains an integrated Instagram component (Insta button), is accessed, the relevant Instagram component automatically causes the internet browser on the data subject's information technology system to download a display of the corresponding component from Instagram. As part of this technical process, Instagram learns which specific subpage of our website the data subject visits.
If the data subject is logged in to Instagram at the same time, Instagram recognises which specific subpage the data subject visits each time they access our website and throughout their visit. This information is collected by the Instagram component and assigned by Instagram to the data subject's Instagram account. If the data subject clicks one of the Instagram buttons integrated into our website, the data and information transmitted as a result are assigned to the data subject's personal Instagram user account and stored and processed by Instagram.
Instagram always receives information through the Instagram component that the data subject has visited our website if the data subject is logged in to Instagram at the time of accessing our website; this happens regardless of whether the data subject clicks the Instagram component. If the data subject does not want this information to be transmitted to Instagram, they can prevent the transmission by logging out of their Instagram account before accessing our website.

Further information about LinkedIn plug-ins is available at https://developer.linkedin.com/plugins. As part of this technical process, LinkedIn learns which specific subpage of our website the data subject visits.
If the data subject is logged in to LinkedIn at the same time, LinkedIn recognises which specific subpage of our website the data subject visits each time they access our website and throughout their visit. This information is collected by the LinkedIn component and assigned by LinkedIn to the data subject's LinkedIn account. If the data subject clicks a LinkedIn button integrated into our website, LinkedIn assigns this information to the data subject's personal LinkedIn user account and stores these personal data.
LinkedIn always receives information through the LinkedIn component that the data subject has visited our website if the data subject is logged in to LinkedIn at the time of accessing our website; this happens regardless of whether the data subject clicks the LinkedIn component. If the data subject does not want this information to be transmitted to LinkedIn, they can prevent the transmission by logging out of their LinkedIn account before accessing our website.
At https://www.linkedin.com/psettings/guest-controls, LinkedIn offers the option to unsubscribe from email messages, text messages and targeted advertisements, and to manage advertising settings. LinkedIn's cookie policy is available at https://www.linkedin.com/legal/cookie-policy.
24. Data protection provisions on the use of Pinterest
The controller has integrated components of Pinterest Inc. into this website. Pinterest is a so-called social network. A social network is a social meeting place on the internet, an online community that generally allows users to communicate with each other and interact in a virtual space. A social network can serve as a platform for sharing opinions and experiences or enable the internet community to provide personal or company-related information. Among other things, Pinterest allows users of its social network to publish image collections and individual images, together with descriptions, on virtual pinboards (so-called pinning), which other users can then share (so-called repinning) or comment on.
The operating company of Pinterest is Pinterest Inc., 808 Brannan Street, San Francisco, CA 94103, USA.
Each time an individual page of this website, which is operated by the controller and contains an integrated Pinterest component (Pinterest plug-in), is accessed, the relevant Pinterest component automatically causes the internet browser on the data subject's information technology system to download a display of the corresponding Pinterest component from Pinterest. 28. Data protection provisions on the use of the Scalable Central Measurement Method of INFOnline GmbH
The controller has integrated a tracking pixel into this website to measure audience reach. A tracking pixel is a miniature graphic embedded in websites to enable log file recording and analysis so that a statistical evaluation can subsequently be carried out. The integrated tracking pixels are used for the Scalable Central Measurement Method (SZM) of INFOnline GmbH.
The Scalable Central Measurement Method is operated by INFOnline GmbH, Forum Bonn Nord, Brühler Str. 9, 53119 Bonn, Deutschland.
The Scalable Central Measurement Method is used to determine statistical indicators, that is, to measure audience reach. The embedded tracking pixel is used to track whether, when and by how many users (including the data subject) our website was opened and which content was accessed.
Setting the opt-out cookie may mean that the controller's websites can no longer be used in full. INFOnline's applicable data protection provisions are available at https://www.infonline.de/datenschutz/.
29. Data protection provisions on the use of DoubleClick
The controller has integrated DoubleClick by Google components into this website. DoubleClick is a Google brand under which primarily specialised online marketing solutions are marketed to advertising agencies and publishers.
The operating company of DoubleClick by Google is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
DoubleClick by Google transmits data to the DoubleClick server with every impression as well as with clicks or other activities. Each of these data transmissions triggers a cookie request to the data subject's browser. If the browser accepts this request, DoubleClick places a cookie on the data subject's information technology system. Cookies have already been explained above. The purpose of the cookie is to optimise and display advertising. The cookie is used, among other things, to place and display advertising relevant to the user and to create or improve reports on advertising campaigns. The cookie also serves to prevent the same advertisement from being displayed repeatedly.
DoubleClick uses a cookie ID that is necessary to carry out the technical process. The cookie ID is required, for example, to display an advertisement in a browser. DoubleClick can also use the cookie ID to record which advertisements have already been displayed in a browser in order to avoid duplicate placements. The cookie ID also enables DoubleClick to record conversions. Conversions are recorded, for example, when a user has previously been shown a DoubleClick advertisement and subsequently makes a purchase on the advertiser's website using the same internet browser.
A DoubleClick cookie does not contain any personal data. However, a DoubleClick cookie may contain additional campaign identifiers. A campaign identifier is used to identify the campaigns with which the user has already interacted.
Each time an individual page of this website, which is operated by the controller and contains an integrated DoubleClick component, is accessed, the relevant DoubleClick component automatically causes the internet browser on the data subject's information technology system to transmit data to Google for the purposes of online advertising and calculating commissions. As part of this technical process, Google obtains data that it also uses to prepare commission calculations. Among other things, Google can track whether the data subject has clicked certain links on our website.
As already explained above, the data subject can prevent our website from setting cookies at any time by adjusting the settings of the internet browser used, thereby permanently objecting to the setting of cookies. Such a browser setting would also prevent Google from placing a cookie on the data subject's information technology system. Cookies already set by Google can also be deleted at any time through an internet browser or other software programs.
Further information and the applicable data protection provisions of DoubleClick by Google are available at https://www.google.com/intl/de/policies/.
30. Data protection provisions on the use of Tradedoubler
The controller has integrated Tradedoubler components into this website. Tradedoubler is a German affiliate network that offers affiliate marketing. Affiliate marketing is an internet-based form of sales that enables commercial website operators, known as merchants or advertisers, to display advertising, usually remunerated through click or sales commissions, on third-party websites, that is, on the websites of sales partners also known as affiliates or publishers. Through the affiliate network, the merchant provides advertising material, such as an advertising banner or other suitable means of internet advertising, which an affiliate subsequently incorporates into their own websites or promotes through other channels, such as keyword advertising or email marketing.
The operating company of Tradedoubler is Tradedoubler GmbH, Herzog-Wilhelm-Straße 26, 80331 München, Deutschland.
Tradedoubler places a cookie on the data subject's information technology system. Cookies have already been explained above. Tradedoubler's tracking cookie does not store any personal data. It stores only the identification number of the affiliate, that is, the partner referring the potential customer, as well as the reference number of the website visitor and of the advertising material clicked. The purpose of storing these data is to process commission payments between a merchant and the affiliate, which are handled through the affiliate network, that is, Tradedoubler.
As already explained above, the data subject can prevent our website from setting cookies at any time by adjusting the settings of the internet browser used, thereby permanently objecting to the setting of cookies. Such a browser setting would also prevent Tradedoubler from placing a cookie on the data subject's information technology system. Cookies already set by Tradedoubler can also be deleted at any time through an internet browser or other software programs.
Tradedoubler's applicable data protection provisions are available at http://www.tradedoubler.com/de/datenschutzrichtlinie/.
31. Payment method: Data protection provisions on PayPal as a payment method
The controller has integrated PayPal components into this website. PayPal is an online payment service provider. Payments are processed through so-called PayPal accounts, which are virtual personal or business accounts. PayPal also offers the option of processing virtual payments by credit card if a user does not have a PayPal account. A PayPal account is managed through an email address, so there is no conventional account number. PayPal enables users to initiate online payments to third parties or receive payments. PayPal also performs trustee functions and offers buyer protection services.
The European operating company of PayPal is PayPal (Europe) S.à.r.l. & Cie. S.C.A., 22-24 Boulevard Royal, 2449 Luxembourg, Luxemburg.
If the data subject selects "PayPal" as the payment option during the ordering process in our online shop, the data subject's data are automatically transmitted to PayPal. By selecting this payment option, the data subject consents to the transmission of personal data necessary to process the payment.
The personal data transmitted to PayPal generally consist of first name, surname, address, email address, IP address, telephone number, mobile telephone number or other data necessary to process the payment. Personal data relating to the respective order are also necessary to perform the purchase contract.
The purpose of transmitting the data is payment processing and fraud prevention. The controller will transmit personal data to PayPal in particular where there is a legitimate interest in the transmission. PayPal may transmit the personal data exchanged between PayPal and the controller to credit reference agencies. The purpose of this transmission is identity verification and creditworthiness assessment.
PayPal may disclose the personal data to affiliated companies and service providers or subcontractors insofar as this is necessary to fulfil contractual obligations or the data are to be processed on its behalf.
The data subject may withdraw their consent to the handling of personal data by PayPal at any time. Withdrawal does not affect personal data that must necessarily be processed, used or transmitted for payment processing in accordance with the contract.
PayPal's applicable data protection provisions are available at https://www.paypal.com/de/webapps/mpp/ua/privacy-full.
32. Legal basis for processing
Article 6(1)(a) GDPR serves as the legal basis for our company's processing operations for which we obtain consent for a specific processing purpose. Where the processing of personal data is necessary for the performance of a contract to which the data subject is a party, for example processing operations necessary for the delivery of goods or the provision of another service or consideration, the processing is based on Article 6(1)(b) GDPR. The same applies to processing operations necessary to take pre-contractual steps, for example in the case of enquiries about our products or services. If our company is subject to a legal obligation that requires personal data to be processed, for example to comply with tax obligations, the processing is based on Article 6(1)(c) GDPR. In rare cases, the processing of personal data may become necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured at our premises and their name, age, health insurance details or other vital information then had to be passed on to a doctor, hospital or other third parties. In that case, the processing would be based on Article 6(1)(d) GDPR. Finally, processing operations may be based on Article 6(1)(f) GDPR. This legal basis applies to processing operations not covered by any of the aforementioned legal bases where processing is necessary for the purposes of a legitimate interest pursued by our company or a third party, provided that the data subject's interests, fundamental rights and freedoms do not override that interest. Such processing operations are permitted in particular because they were specifically mentioned by the European legislator. In this respect, the legislator considered that a legitimate interest could exist where the data subject is a customer of the controller (Recital 47, sentence 2 GDPR).
33. Legitimate interests in processing pursued by the controller or a third party
Where the processing of personal data is based on Article 6(1)(f) GDPR, our legitimate interest is conducting our business for the benefit of the well-being of all our employees and our shareholders.
34. Period for which personal data are stored
The criterion for the period for which personal data are stored is the respective statutory retention period. After this period expires, the corresponding data are routinely erased, provided that they are no longer necessary for the performance or initiation of a contract.
35. Statutory or contractual requirements to provide personal data; necessity for entering into a contract; obligation of the data subject to provide personal data; possible consequences of failing to provide such data
We inform you that the provision of personal data is in some cases required by law (for example, tax regulations) or may also result from contractual provisions (for example, information about the contracting party). In some cases, entering into a contract may require a data subject to provide us with personal data which we must subsequently process. For example, the data subject is obliged to provide us with personal data if our company enters into a contract with them. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before providing personal data, the data subject must contact one of our employees. Our employee will explain to the data subject, on a case-by-case basis, whether the provision of the personal data is required by law or contract or is necessary to enter into the contract, whether there is an obligation to provide the personal data and what the consequences of failing to provide the personal data would be.
36. Existence of automated decision-making
As a responsible company, we do not use automated decision-making or profiling.
